hi, this is a longstanding issue with .3ds import. I have tested 100's of models from many sites. The success ratio was around 50% of .3ds files have the wrong position, most of these files were from older archive model sites. That said I have also tested the same files in hexagon with mixed results. Some of the failing files imported very well, others still had "artifacts/wrong position". It may be that older .3ds files fail & newer .3ds are ok, but I cannot be sure on that.
I would like to see this fixed but afaik it's been a problem for years & not entirely blenders fault.

confirm randomic problem.
all my 3ds are from max/viz 3 (very old version!) but some models are imported well, and some are wrong.
Changed status from 'Open' to: 'Archived'
As this issue is known problem for years & no action has been taken nor is likely to be taken this task is being archived.
