Deleting a branch is permanent. Although the deleted branch may continue to exist for a short time before it actually gets removed, it CANNOT be undone in most cases. Continue?

9e08019b74An empty layer is shown as having something there.
Previously there was objects in the layer 3. When remove them, the layer still sinalize that there are some stuff in it.gold.blend

It seems this is not a bug : there is a hidden Plane in the 3rd layer. If you show it (the eye icon in the outliner, in front of it) you will see it.
