I have declared the problem directly from the blender interface, which usually brings all the needed context information along. Dont know why it did not work that time.
Anyway version was blender 2.82a

So if I understand correctly:
1 "Use for Rendering" OFF for a layer of scene A means "keep previous render for that layer" when compositing that layer from a different scene B
2 "Use for Rendering" OFF for a layer of scene A means "dont use that layer in composition" when compositing that layer in the same scene A

The whole point is not to hide the cube with "use to for rendering" ON.
Here the steps that shows the problem for me:
1 Load the file, load factory settings, swicth to scene named "render", do render
-> I see only the sphere alone : CORRECT
2 switch to scene "cube" set "use to for rendering" ON, go back to scene "render", do render
-> I see the sphere and the cube: CORRECT AGAIN
3 switch to scene "cube" set "use to for rendering" OFF, go back to scene "render, do render
-> I see the sphere and the cube: INCORRECT

For someone who may face the same problem as me here is the snapshot of the solution
I fact there was a popup for me each time I started the to edit the blend file in 2.82.
This popup was proposing to allow permanently the execution of scripts which were deasabled by default for security reason.
Once I selected "allow permanently" the driver worked.
And now it works all the time.
The file works for me with blender 2.81a.
But it does not work with blender 2.82.
Problem is still there.
Here is the blend file (NB: for blender 2.82)
I still think it is a bug. And an important one.
Here is a screenshot for a better understanding. (Very simple to reproduce)

The workaround (adding a modifier) did not work for me in blender 2.79.
This makes it impossible to use light maps along with tiles texture in BGE because UV map for light maps are not convinient for tiles as far as I know.
Hope this will be fixed some day
