The color prop in the Brushes panel in the tools tab in Properties editor is greyed out for the grease pencil object in draw mode. And so not editable. The same prop in the topbar is functional.
And here you can change the color.

Open Blender, create grease pencil object, switch to Draw mode. Have a look into the brush panel in the properties editor in the tools tab.

This is not a bug, but a misunderstanding. The top color selector is to select a material for drawing, but the material of the brush is only active if you pin the material to the brush. What you see in the Tool panel is the material pinned, so if the pin is not enabled, the control must be disabled.
