Why just not leave it as it is?

Well, that new slider offers all the functionality of the target and more. Having both is redundant in my opinion.

I would even have the fallback option enabled even when you do have a target. That way you could have the normal behavior of the constraint, driven by a bone, but you could also counteract the effect with a driver on the fallback value.

I don't like that idea to be honest. To me having two nearly identical ways of doing the same thing is a design flaw and it will make creating that mental map of how the rig works a lot harder.
Drivers already give you great flexibility and if you wanted to have some layering of logic to counteract something you could do it through the driver, giving you one obvious place to find any potential issue instead of two.

An idea is to have an "is_legacy_target" property, so old constraints show the old UI. This would still break backwards comp with python scripts that try to add Action constraints. But it is bcon1 and if we're gonna break backwards comp, now is the time. (Just note this would need release notes and documentation updates)

Agreed.
Ideally, we would remove all the target related properties but that would break compatibility with earlier rigs. Not sure where Blender stands regarding that.

I just tested with the file I uploaded on T64512 and it doesn't crash anymore, all my files that were crashing due to this issue seem to be fine as well.
I haven't tested with files from this task and from T64648

I just tried and the problem is still there. Though for some reason the scene that I provided doesn't create a render that causes a crash (the provided image does).
Here is a new blend file with the bug


I tested with 7ae44e8 and the file has been created with this version as well.
